Welcome to Boothby
These terms govern your use of Boothby, a learning log and evidence app for documenting children's educational activities. By using Boothby, you agree to these terms.
We've written these terms to be clear and fair. If something doesn't make sense, please ask us at support@getboothby.com.
The Basics
What Boothby Is
Boothby is a software service that helps you:
- Record learning activities your children do
- Attach photos as evidence
- Organise activities by date, subject, and learner
- Search and filter your records
- Export reports for homeschooling compliance or portfolios
What Boothby Isn't
- Not educational advice: We provide tools for documentation, not curriculum guidance or educational recommendations
- Not a guarantee: We can't guarantee that your documentation will satisfy any particular regulatory requirement, school admission, or other formal process
- Not a backup service: While we keep your data safe, you should maintain your own backups of important photos and records
Your Account
Eligibility
To use Boothby, you must:
- Be at least 16 years old
- Provide accurate information when you sign up
- Not use the service for any illegal purpose
Account Security
You're responsible for:
- Keeping your password secure
- Any activity that happens under your account
- Notifying us immediately at security@getboothby.com if you suspect unauthorised access
We're not liable for losses caused by unauthorised use of your account if you haven't notified us.
Social Logins
If you sign in using a third-party provider (Google, Microsoft, Apple), you also agree to follow their terms of service. We're not responsible for issues with those providers.
Using Boothby
Acceptable Use
You agree to:
- Use Boothby for its intended purpose (documenting learning activities)
- Respect other users' privacy and data
- Not attempt to access other users' accounts or data
- Not interfere with the service's operation
- Not use automated tools to scrape or bulk-download data beyond normal use
- Follow applicable laws about photographing and documenting children
Workspace Collaboration
When you invite someone to your workspace:
- You control their access level (owner, editor, or viewer)
- They can see the data in that workspace according to their permissions
- You're responsible for managing who has access
- You can remove their access at any time
When someone invites you to their workspace:
- You're viewing and editing their family's or organisation's data
- You agree to respect their privacy and use the data only as they've permitted
- You won't copy or share their data outside the app without permission
Your Content
What You Own: You own all the content you put into Boothby - the learning entries, photos, notes, everything. We never claim ownership of your data.
What We Need: By using Boothby, you grant us permission to:
- Store your content on our servers
- Display it back to you in the app
- Process it to provide features (like search, calendar views, PDF exports)
- Back it up to protect against data loss
- Access it only when necessary to provide support or fix technical issues
This permission lasts as long as you use Boothby and for a reasonable time afterward to fulfil requests like data exports.
Your Responsibility: You're responsible for the content you upload, including:
- Having the right to photograph and share images of the children
- Following applicable privacy laws in your jurisdiction
- Not uploading illegal, harmful, or inappropriate content
- Not infringing on others' copyrights or intellectual property
Photos and Children's Images
Since Boothby is about documenting children's learning:
- You confirm you have the right to photograph and document the children in your entries
- If you're photographing children other than your own, you're responsible for getting appropriate consent from their parents/guardians
- You understand that photos are private within your workspace unless you choose to share them
We don't review uploaded photos, but we reserve the right to remove content that violates these terms or applicable law.
Service Availability
Current Stage
Boothby is currently in active development. While we aim for reliable service:
- There may be occasional downtime for maintenance or updates
- Features may change as we improve the product
- We're working to make it better every day
No Uptime Guarantee
We strive to keep Boothby available, but we don't guarantee:
- 100% uptime
- That the service will be error-free
- That we'll meet any specific performance standards
- That all features will work perfectly on all devices
Changes to the Service
We may:
- Add new features
- Remove features that aren't working well
- Change how features work
- Update the user interface
We'll always try to notify you of significant changes, but we're not required to.
Pricing and Payment

Payment Terms
- Payments are processed through secure third-party payment processors
- You authorise us to charge your payment method for applicable fees
- All fees are in AUD unless otherwise stated
- Fees are non-refundable except as required by law or as we decide at our discretion
Cancellation
You can cancel your account at any time through the app settings or by contacting support@getboothby.com. Upon cancellation:
- You'll have access until the end of your current billing period
- You can export your data before the account closes
- Your data will be deleted according to our Privacy Policy
Intellectual Property
Our Rights
Boothby itself (the software, design, logos, name, and overall service) is owned by Verdaniq Pty Ltd and protected by copyright, trademark, and other intellectual property laws.
You're granted a limited, non-exclusive, non-transferable licence to use Boothby for its intended purpose. You can't:
- Reverse engineer the software
- Remove copyright or trademark notices
- Use our trademarks without permission
- Sell or redistribute the software
Open Source
Some components of Boothby use open-source libraries. Those components remain subject to their original licences (typically MIT or Apache 2.0).
Privacy and Data
Please read our Privacy Policy for details about how we collect, use, and protect your data.
Key points:
- We don't sell your data
- We don't use tracking/analytics beyond what's necessary to run the service
- You can export and delete your data
- We use industry-standard security practices
Disclaimers and Limitations
Service "As Is"
Boothby is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- That the service will meet your specific needs
- That the service will be uninterrupted or error-free
- That data loss won't occur
Educational and Legal Compliance
We don't guarantee that using Boothby will:
- Satisfy homeschooling requirements in your jurisdiction
- Meet any particular school or institution's standards
- Fulfil legal reporting obligations
You're responsible for understanding and meeting your local educational requirements.
Limitation of Liability
To the maximum extent permitted by law:
We're not liable for any indirect, incidental, special, consequential, or punitive damages, including:
- Lost profits or data
- Costs of obtaining substitute services
- Damage from relying on the service
Our total liability for any claim related to Boothby is limited to the amount you paid us in the 12 months before the claim arose, or $100 (whichever is greater).
Exceptions
These limitations don't apply where prohibited by law. Some jurisdictions don't allow certain disclaimers, so they may not apply to you.
Indemnification
If someone makes a claim against us because of something you did with Boothby, you agree to cover our costs, including:
- Your violation of these terms
- Your violation of someone else's rights
- Your uploaded content
- Your misuse of the service
This doesn't apply to claims arising from our own negligence or wrongdoing.
Disputes and Governing Law
Informal Resolution
If you have a problem, please contact us first at support@getboothby.com. We'll try to resolve it informally.
Governing Law
These terms are governed by the laws of Australia, without regard to conflict of law principles.
Jurisdiction
Any legal disputes will be resolved in the courts of New South Wales.
No Class Actions
To the extent permitted by law, disputes must be resolved individually, not as part of a class action or representative proceeding.
Termination
By You
You can stop using Boothby and delete your account at any time.
By Us
We may suspend or terminate your account if:
- You violate these terms
- You use the service in a way that risks harm to us or other users
- We're required to by law
- We decide to discontinue the service
We'll try to give you reasonable notice unless:
- You've seriously violated the terms
- Providing notice would create legal liability for us
- Providing notice would compromise security or other users
After Termination
After your account is terminated:
- You lose access to the service and your data
- You can request a data export within 30 days
- Your data is deleted according to our Privacy Policy
- Provisions of these terms that should survive (like intellectual property, disclaimers, limitations) remain in effect
Plain Language Commitment
Boothby exists to serve your needs, not to market you or your data. You control it, you export it, you delete it. You can cancel your subscription (if using Boothby Cloud) or delete the app at any time. We will only ever terminate your account in extreme cases, and will never do so without notice or communication unless there is risk of serious and immediate harm to us, you, or other users of Boothby.
General Terms
Entire Agreement
These terms, along with our Privacy Policy, constitute the entire agreement between you and Verdaniq regarding Boothby.
Changes to Terms
We may update these terms occasionally. When we do:
- We'll post the updated version with a new "Last Updated" date
- We'll notify you by email or through the app
- Continued use after notification means you accept the changes
- If you don't agree, you should stop using Boothby
Severability
If any part of these terms is found to be unenforceable, the rest remains in effect.
No Waiver
If we don't enforce a provision, that doesn't mean we waive the right to enforce it later.
Assignment
You can't transfer these terms to anyone else. We may transfer them to a successor company (like if we're acquired).
Force Majeure
We're not liable for delays or failures caused by circumstances beyond our reasonable control (natural disasters, pandemics, wars, government actions, etc.).
